Landlords must give at least 90 days’ written notice before any rent increase (up from 60 days).
There are new lease parity rules: Rent for month-to-month tenants cannot exceed the rent for fixed-term tenants in similar units by more than 5%.
3. Tenant Protections & Enforcement
Tenants may challenge unlawful rent increases. If an error is found, landlords must either fix it or allow the tenant to end the lease penalty-free with 20 days' notice.
The Attorney General has enforcement authority, including the power to fine landlords up to $7,500 per violation.
Tenants may also seek damages, reimbursement of overpaid rent, and legal fees.
4. What’s Different in Bellingham?
Bellingham has added its own protections for renters that go beyond state requirements. If you own property within Bellingham city limits, make sure you’re also in compliance with these local rules:

As of March 28, 2023, landlords must give 120 days’ written notice before any rent increase, regardless of the amount.
🔹 Relocation Assistance
If you increase a tenant’s rent by 8% or more over a 12-month period, and they choose to move out as a result, you may owe:
Three times the tenant’s current monthly rent, or
Three times the current fair market rent for a comparable unit in Bellingham—whichever is higher.
Tenants must request this assistance within 45 days of the notice.
You have 31 days to pay the assistance, and the tenant has five months to relocate.
